The standard warranty for plant materials provided by Natural Concerns, Inc. under this Landscape Contract shall extend for a one (1) year period, for all trees and shrubs. Perennials will be covered under Warranty for a period of (6) months. Warranty period will commence on the Completion of the Work. All plants shall be alive and in satisfactory growth at the end of the warranty period. Natural Concerns, Inc. shall be responsible for a one (1) time replacement under the warranty provided by this paragraph. Replacement plants shall be of the same size and species as the original with no soil additives to be used. Natural Concerns, Inc. warranty excludes, and we are not liable for, any damage or defect caused by abuse, modifications not executed by Natural Concerns, Inc., improper or insufficient maintenance, improper operation, or normal wear and tear under normal usage.
Seed, annuals and transplanted materials are specifically excluded from any Warranty. Sod and Ground Covers (plant materials from 2.5” and 4” pots, or Bare Root) will be living, healthy and watered upon installation and Warrantied for a (24) hour period. Owner will be responsible for watering newly installed sod and Ground Covers after the (24) hour period.
Any material that is 25% or more dead shall be considered dead and must be replaced at no charge if under the Warranty Period. A tree shall be considered dead when the main leader has died back or 25% of the crown is dead. A leader shall be considered to be dead when the tip of the central stem is dead down to a major branch. Deciduous material shall be guaranteed to break dormancy if planted in the dormant season and perennials shall be guaranteed to show signs of healthy growth by June 1.
Owner shall be responsible for providing the following maintenance: (a) Watering all plants (accomplished by thoroughly wetting the root mass every 7-10 days during the growing season, provided there has not been at least one (1) inch of rain in the interim period, provided that owner shall not over water plants); and (b) Cultivation to keep plants free of weeds, insects and disease. If you are unable to care for the plants on these terms, we can provide pricing for these services at your request.
Natural Concerns, Inc. shall not be responsible under any warranty for loss or damage caused by factors or circumstances beyond our control, including but not limited to: fire, severe winter, flood, tornado, vandalism, theft, animals, improper application of pesticides or fertilizers, lack or excess of moisture or delay caused by owner which prevents timely planting.
Warranty is void if payment has not been settled in accordance with the terms of the Contract.
